DECRYPTION – Since the Supreme Court’s decision, each state has adopted its own legislation, very different among Republicans and Democrats.

In Oklahoma, abortion is prohibited in almost all circumstances, even in cases of rape and incest. The only possible exception is for « preserve life » from the mother. In other words, she must be on the verge of death to benefit from it. A few hundred kilometers away, in Illinois, the law allows abortion without any restriction until the fetus is viable, around 24 weeks of pregnancy.

The decision of the Supreme Court, two years ago, on June 24, 2022, to remove the constitutional right to abortion in force for fifty years and to leave it to each state to establish its own legislation created a patchwork very diverse measures. « Instead of calming the debate and simplifying the law on abortion, the opposite has happened. We find ourselves in a chaotic situation with a deeply divided country »summarizes Rachel Rebouché, professor of law at Temple University.
