“Died as a result of the accident”

Doctors believe that a link has been established between the accident and death.
The information was not reported to the court. At the hearing, the president even corrected an error in the citation: the ITT mentioned there was less than thirty days, whereas it had been increased, since the initial certificate, to one hundred days. All that was missing was the tragic epilogue.
The president of the hearing was even concerned about whether the defendant had been concerned about the victim’s state of health. Her lawyer, Ophélie Tardieux, had made her clarify that, no, she had not received any news “but that she had received it from her granddaughter, a nurse in Barbezieux”. This is how she would have learned “that she was better and that she had returned home”.
“An expertise is underway”
“She actually left the hospital to be admitted to a nursing home, then in a second she died on November 28,” specifies François Gaborit.
A “dysfunction of justice” for the lawyer, who wrote to the prosecution to try to understand. “In fifteen years of practice, I had never seen this. Did it go wrong in the investigation services? Has a victim notice been lost, sent to an old address? Why was his daughter not contacted even though she appears in the file? »
He concedes, however: the affair is more symbolic. “This will not call into question the judgment of Angoulême. But it’s important for his daughter.” The qualification could have been different. The victim died more than a month after the accident and was not included in the statistics. “But an assessment is underway. The doctors who looked into the case believe that a link has been established between the accident and the death of my client. The expert must decide.” And, indicates the lawyer, “at 76 years old, Marcelle M. was independent, just presented some amnestic disorders. After the accident, his condition deteriorated rapidly.”
