SIf she was sentenced to a sentence of ineligibility with provisional execution, Marine Le Pen would not be able to run for president in 2027. This potential thunderclap in the French political landscape is an opportunity to question the meaning and the usefulness of ineligibility penalties. Until 2010, this sentence was automatic for certain crimes and misdemeanors. In 2010, the Constitutional Council ruled that this automaticity was opposed to the principle of individualization of sentences. Since then, and after a tightening of the rules under François Hollande then Emmanuel Macron, the penalties of ineligibility are automatic additional sanctions in cases of embezzlement of public funds.

Regardless of what we think of Marine Le Pen’s ideas and her guilt…
