“He had the right to be paid”
Dunlop relied on the fact that the current FC Lorient player (0 matches this season in L2, however) had spent two periods in detention, covering approximately five months of the 22-month period of his claim and during which the club had the right to withhold his salary. When the French international was not in custody, the judge noted that he was “ready and willing to work”while being prevented by a suspension imposed by the Football Association and certain bail conditions which were unavoidable or unintentional on his part. “In these circumstances, and in the absence of any authorization in the contract for the employer to withhold his wages, he was entitled to be paid,” Dunlop said.
