Is the revolution underway? Fifa has just announced, this Tuesday, November 26, that it is suspending all its ongoing cases related to transfer rules. A decision which is the direct consequence of the judgment rendered by the Court of Justice of the European Union (CJEU), on October 4, concerning the Lassana Diarra case. As a reminder, the former French international was opposed to Fifa because of a dispute dating back to 2014. At the time, Lokomotiv Moscow had claimed 20 million euros from Diarra after the latter’s decision to leave the club.
The transfer market revolutionized this winter?
By siding with the former PSG player, the CJEU therefore rendered obsolete several points of the regulations on the status and transfer of players (RSTJ), considering that they were contrary to European Union law and likely to hinder free movement
professional footballers.
This November 26, Fifa has therefore abandoned several points of the RSTJ and will no longer sanction players and coaches not respecting the application of financial rights
et joint liability
clubs. In other words, from the next transfer window, players and coaches will be free to leave their club without running the risk of a heavy sanction as was the case for Lassana Diarra.

This decision could therefore have a huge impact on the current transfer system by calling into question the very functioning of the transfer market. However, Fifa specifies that it does not rule out later recovery
of these measures and considers that its decision does not constitute a admission of illegality of such measures
