Donald Trump will have the power to “erase all federal trials” involving him once he enters the White House, according to a former federal prosecutor in the United States.

Eric Lisann, a former federal prosecutor in the United States, mentioned in an interview with LCN on Wednesday that the Republican said “very clearly that he did not want these trials to continue.” These proceedings focus on Donald Trump’s attempts to overturn the results of the 2020 election and his withholding of classified documents after leaving the White House.

“As long as he is president, he will be able to exercise his powers to effectively erase all of these trials. He’s going to fire the Justice Department’s special prosecutor, Jack Smith, and that will be the end of it. He has the power, even if it is extraordinary,” he maintained.

The dismissal of the special prosecutor could happen very quickly, Mr. Lisann estimated. Once again president, Donald Trump could either appoint a new Minister of Justice who would fire Jack Smith, or order his Department of Justice to drop the prosecution against him.

Discussions are already underway between the special prosecutor and the Ministry of Justice with a view to stopping the proceedings, AFP reported.

“As soon as Trump takes office, January 21, 2025 […] he will exercise his power over [du ministre] which is in place. He’s going to order him to fire Jack Smith, that’s for sure,” Eric Lisann said.

Asked by AFP, the ministry declined to comment. However, the organization has followed a policy of not prosecuting a sitting president for more than 50 years.

Sentence expected at the end of the month

Donald Trump will, however, have difficulty avoiding the sentence that awaits him on November 26, since the latter was found guilty by the authorities of a state, indicated Eric Lisann.

“So this one is a little different because it wasn’t conducted by the feds. It was carried out by New York State authorities. So, the decision will remain with Juan Merchan, who has his own function and his own role politically,” he illustrated.

However, the judge responsible for the trial risks taking into account Donald Trump’s presidential obligations when considering his fate.

“At first [le juge] said no, we should not consider that he is a candidate [à la présidentielle]. But afterward, he made remarks making it clear that Trump is not a normal person. It can be treated differently. “It remains a question,” he said.

Remember that Donald Trump was found guilty on May 30 of 34 counts after having concealed payments of money to pornographic actress Stormy Daniels. He could get four years in prison.
