Since January 1, this advertisement has been prohibited, both online and in real estate agency windows. The Climate and Resilience law of August 22, 2021 prohibits the rental of all properties classified G in the energy performance diagnosis (DPE, mandatory document provided to the tenant, which provides information on the energy consumption of the accommodation and its gas emissions at greenhouse).
In Vaucluse, “which has precisely 311,566 housing units, 6% of which are classified G“, according to Jonathan Le Corronc Clady, president of Fnaim 84 and himself a real estate agent, more than 6,000 homes would be affected, by extrapolation with national data (1). The law charges them with “housing(s) with excessive energy consumption“(a mention previously obligatory on advertisements) because of a consumption greater than 450 kilowatt hours (kWh) per square meter and per year in final energy. To make an impression, the legislator even considers them as “indecent within the meaning of the new legal framework of the term“.
Real risks for the landlord
What does the landlord risk? First, if he persists in wanting to rent his property, he “may be fined a maximum of €3,000 (€15,000 if it is a legal entity)” (art. L131-1 of the Consumer Code).
