C‘is definitive. The Ministry of Industry and Trade as well as that of the Economy jointly decided, by an order of December 24, 2024, to impose for a period of five years an anti-dumping duty on electric ovens imported from Turkey.
The administration of customs and direct taxes (ADII) announced the immediate application of this measure in a circular published on January 3. As a reminder, dumping is a practice which consists of selling on foreign markets at prices lower than those of the national market, or even lower than the cost price.
Such a decision had already been taken on June 24, 2024 through a circular, which provided for the application for six months of an anti-dumping duty on Turkish ovens. Thus, the company Itimat Makina Sanayi had to pay an additional duty of 34.05%, and the other companies producing electric ovens manufactured in Turkey the same tax of 62.07%.
The judgment therefore confirms this decision – with a slight drop for the Itimat company to 32.82% – and allows the customs service to “proceed to the definitive collection of the amount deposited for the provisional anti-dumping duty”, indicates the press release.
The difference in treatment is explained by the participation of the Itimat company, which cooperated with the authorities by providing responses to the investigation by the Ministry of Industry, initiated in 2023.
For other Turkish market participants who did not cooperate or did not sufficiently cooperate with the investigators, the tax established was calculated based on the best available information. The additional duty was determined based on the margin calculated on the profit from dumping.
The ministry estimated that this margin induced an additional duty of 71.43%, but did not wish to apply this amount for “limit the impact of this measure on the consumer”, explained the government last June.
This decision concerns “mobile, non-built-in electric ovens, with a capacity not exceeding 70 liters, intended for domestic use and originating in Turkeye”, specifies the press release, with the exception of “Air Fryers” type products.
