These companies renounce legal proceedings for the construction site of this hospital in Val-d'Oise

The 85,000 m² new buildings of the hospital center de Gonesse (Val-d'Oise) should have been inaugurated at the end of 2014, with a reception date initially set for November 28, 2014.

But the works – which should therefore have lasted two years – had fallen behind schedule due to “certain disorganization”, according to market players:

One of the companies holders of this public contract had gone bankrupt and this had, for the others, consequences on “the extension of the duration of the works and their profitability.

315.5 million euros

It was therefore necessary to relaunch the calls for tenders for this construction site at the final cost amounting to 315.5 million euros, and the new hospital was finally able to open in the summer of 2016, therefore accusing almost two years of retard.

Since August 2022, it was at the justice administrative authority that was responsible for arbitrating this dispute:

The companies intervened in the partitions, the fakes ceilingsinterior finishes, interior joinery had filed an appeal to request an “expertise” to determine “the cause of the modifications to the walkthe examination of the delays incurred on the construction site as well as their consequences.

The Gonesse hospital center – whose “responsibility” for the delay had been estimated at “17%” – was ultimately considered “owable” for a total sum of around 9.4 million euros excluding taxes and €891,000 excluding taxes for “additional work requested”.

Taking into account the transactions already carried out between the parties, the administrative court of Cergy Pontoise had sentenced the company Axima Concept to pay 1.4 million euros to the Gonesse hospital center in settlement of the market balance.

The company Union Technique du Batiment (Utb) for its part had to pay €53,500 including tax to the establishment of health.

The companies also had to compensate each other.

THE architects Parisians Valode and Pistre were notably ordered to pay €119,000 to Axima Concept and €164,000 to Utb.

But Axima and Utb returned to the charge in front of the administrative court of appeal of Versailles to order the hospital to pay them 9.7 million euros in “market balance”.

Disclaimer

The two finally withdrawn of their appeal and, in an order dated September 2, 2024 which has just been made public, the summary judge of the administrative court of appeal of Versailles “gave note” this time of the withdrawal “pure and simple ” of Gonesse hospital center.

The companies subsequently made it known that they accepted his withdrawal.

The convictions handed down therefore became final and the dispute is now closed.
