After spending almost a month in prison, a 29-year-old man was tried Friday by the Montauban judicial court. At the end of the hearing, he was found guilty of the facts he was accused of, to which he had admitted.

On Friday, a 29-year-old man from Foix appeared before the Montauban judicial court for violence he allegedly committed against his partner on June 2 at her home in Albias. Having requested time to prepare his defense, the almost thirty-year-old, deaf and mute, had been incarcerated since the day after the events.

During her trial, the presiding judge, Audrey Trafi, recalled the context of the evening: “You were drunk and angry. Your partner says that you had consumed 5 bottles of wine.” While the couple was on a video call with friends on WhatsApp, the situation got out of hand. The interlocutor then recounted having witnessed a scene of violence, where the accused had allegedly threatened his partner with death, “with a BB gun,” the judge said. Their son, just one year old, and the friend had also been threatened by the young man.

Alerted by the witness’s mother, who also recorded the scene, the police arrested the Ariégeois in the evening.

The partner does not file a complaint

Faced with the video recording, the deaf-mute man confirmed to the court through his interpreter that he acknowledged the facts he was accused of. “I made mistakes, I regret it. Alcohol doesn’t have a good effect on me. I thought a lot in prison, what I did wasn’t right, I have to change,” he explained through the assistant’s voice.

“The partner is not filing a complaint,” said the deputy prosecutor, Lisa Bergereau, who also did not fail to point out that he had already been convicted of violence against his partner a few months ago. She is requesting 3 months in prison and a ban on owning a weapon for 3 years.

The young man’s lawyer recalled that his disability caused him enormous difficulties in his daily life and that his time in prison had been “a great suffering”, with nothing being thought of for people like him. “His time in prison was necessary but it must end. He feels the vibrations produced by noise very acutely, and this makes him suffer”, she argued.

After a short suspension, the judges found the Ariégeois guilty and sentenced him to 3 months in prison. He was served with a summons before the sentencing judge, during which he will be able to request a sentence reduction. He is also prohibited from possessing a weapon for 3 years and must not contact his partner or go to her home.
