The summary of the investigation – conducted for several months by the Villeneuve research brigade – by the president of the Agen correctional chamber, is much more extensive than the explanations of the three men posted in front of him, this Friday, June 28.

In front of a packed courtroom, the magistrate reviewed the numerous investigative acts, but also the searches carried out in the vehicles and at the homes of the three defendants, which led to the total seizure of more than 120,000 euros, several kilos of cannabis (in the form of grass and resin), several dozen grams of cocaine and the more unusual seizure of a white-crested marmoset, a protected species.

Large quantities of drugs were seized, as well as large sums of money… And a white-crested marmoset, named “Three Apples”.

Lot-et-Garonne Gendarmerie

The representative of the public prosecutor unfolds what binds the three defendants aged 24, 34 and 35, when they admit to knowing each other, lip service, and deny any criminal organization. The large sums of money found in their accounts, the brief trips to the countryside while the eldest’s car is geolocated, the telephone tapping, the presence in the same places of their relatives, the incriminating effects found during searches…: “You have the elements of the procedure, in the face of the weakness of today’s statements”, weighed the prosecution, having launched an investigation following the denunciation of the trafficking.

Up to 20,000 euros fine

On the defense benches, the lawyers denounce the weakness of “a case, with very high expectations.” Like M’s cliente Elea Cerdan, whose criminal record contrasts with the prosecutions for use and failure to justify resources, in connection with a drug trafficking relationship. “These three are being wiretapped and not once do they call or speak to each other. What is being claimed against him is incoherent. The mountain has given birth to a mouse.”

Prison sentences of ten months to four years, three of which are firm, and fines of up to 20,000 euros have been requested for the defendants. The decision has been adjourned until July 5.
