The Pascal Jaussi affair is taking on the appearance of a hot potato for the Friborg justice system. By decision of the Attorney General, it is the Broye District Criminal Court which will hear the trial of the space entrepreneur who has fallen into disgrace, unless there is an appeal to the Criminal Chamber of the Cantonal Court.
However, the body withdrew from the case at the beginning of October, considering itself incompetent in the matter. She had pleaded with the Public Prosecutor’s Office for the Economic Criminal Court to take over the case. However, the latter also contested his jurisdiction.
In the opinion of the Attorney General, Fabien Gasser, this case does not require special economic knowledge on the part of the assessor judges, most of the offenses being tried are not of an economic nature, such as intentional arson or induction of justice in error.
In addition, offenses of fraud, breach of trust, forgery of securities or certificates are generally not sufficient to be referred to the Economic Criminal Court. Those more specific of faulty or unfair management “are based on a relatively simple modus operandi”, believes Fabien Gasser.
Opened on August 26, 2016, the instruction lasted 8 years. Pascal Jaussi had staged his attack, after inflicting burns on himself and setting his car on fire in Cugy/Vesin. He is accused of having cleverly embezzled 4.8 million francs.
