Tentative de suicide
At the bar, the accused bases his defense on “his isolation during confinement”. He also sent numerous messages to the young girl during this period, asking her questions about her intimate life.
If he ends up admitting that at 13, “she could not consent”, he has no memory “of her saying no, of pushing him away”. The next day, the teenager confided in her mother.
At the hearing, she cried when her counsel mentioned her suicide attempt on June 23, 2023. Me Roux added:
“Her mother blames herself for having opened her door to someone who betrayed her. »
“Treason is the central word in this case,” immediately declares the prosecutor for whom the facts are characterized.
“Age difference and minority legally characterize sexual assault”, the magistrate insists on this “attack of full opportunity”.
What worries him greatly is that the defendant has not confessed these facts to the woman who has shared his life for two years and with whom he is preparing to start a family. In fact, the thirty-year-old declared to his partner that on November 12, he was going to work.
The representative of the public prosecutor asks:
“He does not take ownership of the facts committed, this can only lead to a catastrophe and that does not bode well in my eyes. »
After having explained that “not everyone had the same behavior during confinement”, Me Mahaut Vançon focused on the feelings of his client, who had just suffered a professional failure and a personal failure, which caused him a loss of confidence.
For him too, she clarified, the facts were not trivial: “He lost his appetite, had nightmares…”
The defense lawyer highlighted her particularly well-respected judicial supervision during these years of investigation.
Four years in prison, one of which is closed
The court followed the requisitions: four years in prison, three of which were suspended for two years.
The 30-year-old will have to undergo psychiatric and psychological care and is prohibited from any contact with the victim to whom he will have to pay €5,000 in moral damages, plus €1,500 to his mother. He will also have to pay €90 in medical costs and €1,800 in lawyer fees.
