The Federal Court is considering this Wednesday in a public hearing the change of party of Zurich MP Isabel Garcia. Several elected officials contested the confirmation of the results of the election to the Grand Council after the elected Green Liberal joined the ranks of the Liberal-Radical Party.

Registered on the Liberal Green Party list, the MP obtained 3,023 votes in the February 2023 Parliamentary election, which guaranteed her a new mandate. The next day, the press announced that Isabel Garcia had informed her party that she was joining the Liberal-Radical Party (PLR).

Six politicians from several parties are attacking the validation order issued by the Grand Council on May 8, 2023. They are asking the Federal Court to find a violation of political rights and to annul this decision with regard to Isabel Garcia.

Registered on the Liberal Green Party list, the MP obtained 3,023 votes in the February 2023 Parliamentary election, which guaranteed her a new mandate. The results of the vote were published in the official notice sheet of the canton and no appeal was filed during the 15-day appeal period which expired on February 22.

Majority lost

The next day, the press announced that Isabel Garcia had informed her party that she was joining the Liberal-Radical Party (PLR). A transfer which caused the center-left coalition to lose its narrow majority in the Zurich Parliament.

During the validation of the results on May 8, 2023, the Alternative List and the Greens asked the plenum to oppose the confirmation of the election of Isabel Garcia. Both parties considered that the person concerned had contravened the principle of good faith. Their request was rejected by 107 votes to 52 with 11 abstentions.

In addition to the annulment of the validation order, the appellants also ask the Federal Court that the designation of the commissions be annulled, that the illegitimacy of the election of Isabel Garcia to a commission be noted and that the case be referred to the Council of State for new decision.
