The High Court has ruled: the appeal filed by the director of the Petit Bolide motocross school in Treize-Cantons (Valbroye) against the decision of the canton of Vaud was recently rejected. In its judgment, the Federal Court thus ruled in favor of the General Directorate of Territory and Housing (DGTL), according to information published in 24 hours. The DGTL had in fact not validated the La Bruyère allocation plan carried out in 2021 by the municipality of Valbroye, a plan affecting the site hosting the school in a tourism and leisure zone so that it can continue its activity. A refusal supported by the Court of Administrative and Public Law (CDAP) of the canton of Vaud last year.

The TF emphasizes that the appellant was able to operate his motocross school for several years in Moudon in the Pré-Bryand industrial zone, that is to say in a building zone, and that he could probably continue to do so at the future. He also notes that the appellant did not carry out “a serious evaluation of alternative sites by examining at the regional level whether there was an appropriate use zone in the building zone”. As indicated in the judgment, “the major public interest represented by the preservation of non-building zones and the fundamental distinction between built space and land located outside the building zone should lead to the refusal to legalize a new motocross track on land located outside the building zone.

Remember that the school of ex-pilot Olivier Monnier has been closed since 2013 following a decision by the Federal Court and that, according to the information in the judgment, the lease of the Romand piloting educational center in Moudon is coming to an end. deadline at the end of June, jeopardizing Olivier Monnier’s family business. The latter remained unreachable.
