Two young people who refused to comply with a police check and a police officer who was following them were injured in Nice on Tuesday, September 10. The passenger’s custody was lifted, while the driver, who tested positive for cannabis, will be brought before the courts on Thursday.

The scooter driver, who refused to comply in Nice and injured a municipal police officer on Tuesday, September 10, will be brought to justice on Thursday, the Nice public prosecutor said in a statement. He tested positive for cannabis after the incident, according to the prosecution.

“The person concerned will be prosecuted for unintentional injuries while driving a vehicle resulting in total incapacity for work of less than 3 months (in this case the ITT of the police officer victim is 45 days),” explains the prosecutor.

An aggravated charge of two circumstances: “driving under the influence of narcotics” and “deliberate failure to comply with an obligation of prudence”.

The young man, born in 2008 and unknown to the justice system, “will also be prosecuted for refusing to comply with an order endangering the lives of others.”

Placement under judicial supervision required

The young driver of the two-wheeler, accompanied by a passenger who was also a minor, refused to comply to a check by a municipal police car asking them to stop, first at Place du Commandant Gérôme then at Avenue Brancolar in Nice this Tuesday.

They then fled and, while trying to escape, hit a municipal police scooter “head on”, BFM Nice Côte d’Azur learned from the national police.

The prosecution will request that the driver be placed under judicial supervision, as well as a ban on driving any motor vehicle and an obligation to check in every 15 days, in addition to an obligation to seek treatment.

The young passenger’s custody has since been lifted, “no offence” having been noted against her.
