The appeal was filed with the Bordeaux administrative court by the Citizen Association for the Fight against Waste 24 for a Public Service (ACLD24SP). The latter mainly called for the return of door-to-door waste collection, with voluntary drop-off points being reserved for certain limited cases.
On July 17, 2024, the judge dismissed the request, finding that it was not urgent. The decision was attacked by the association which appealed, at the end of August, to the litigation secretariat of the Council of State.
The latter rendered his decision on December 23: the appeal was rejected. It is now the court's hearing on the merits, the date of which is not known, which will definitively decide the request.
Heart of Garonne
This situation is reminiscent of another, in Haute-Garonne. In the Cœur de Garonne community of communes, the move to collection at voluntary drop-off points had also been challenged before the administrative courts. Initially, at the end of 2023, the summary judge followed the opponents, before backpedaling in January 2024.
So much so that, contrary to what was written in our article “Waste collection in Dordogne: can we do otherwise? », there was no return to door-to-door collection. At least not for the moment since here too, it is a hearing on the merits, which must take place on January 14, which will definitively decide this request.
Pascal Protano, president of the Dordogne Departmental Waste Syndicate (SMD3), observes the two situations with interest. He recalls in passing that in Dordogne, the collection reform “was voted on in July 2018 unanimously by the elected officials who sit on the SMD3”, a way of showing that it is not “a decision unilateral”.
And it maintains its usefulness, proven by the increase in the collection of recyclable materials by 30% between 2022 and 2024, i.e. as much as the drop in household waste, a calculation which includes illegal dumping which is also collected.
