Request for provisional injunction rejected: the City of Laval suffers a first setback against Cavalia

The City of suffered a first setback in its legal action against Cavalia, whom it accuses of illegally occupying its land since the end of the illumi event.

The Superior Court rejected the City’s request for a provisional injunction, which will therefore not be able to obtain the nearly $7,671 per day that it has been demanding from Cavalia since 1is last September.

In his decision, Judge Enrico Forlini mentions in particular that the City has not demonstrated that this was an urgent situation or that it would suffer serious harm without this monetary compensation.

“The City of Laval lost its case against us today, an action that remains incomprehensible. We do not understand why the City is coming after us by taking legal means, while all we are asking is to find an agreement with the City to complete the dismantling,” reacted Dimitri Soudas, vice-president senior from Cavalia.

The Journal revealed on November 28 that Cavalia had still not collected numerous equipment and waste on the grounds of the illumi Laval event, despite the fact that the agreement for the occupation of the land belonging to the City had ended on November 1is September 2024.

“Although the provisional injunction has not been granted, the City will continue its efforts to force Cavalia inc./illumi to vacate the illegally occupied land, to restore it to clean condition, without debris or waste, in addition to their claim damages for the illegal occupation of the land after 1is September 2024,” reacted Jonathan Lévesque, spokesperson for the City of Laval.

A further hearing on the matter is scheduled for January 2025, where the parties will argue the request for an interlocutory injunction. The judge will then have to decide on the eviction of the land requested by the City.
