The young man who seriously injured a police officer by forcing a roadblock in Winterthur in October 2019 was dismissed by the Federal Court. His sentence of 16 years, suspended in favor of an inpatient therapeutic measure, is final.

The young man did not want the police officers to die but, by rushing off and passing by the sidewalk where they were, he put up with the mortal risks he posed to them, the court said. (illustrative image)

In its verdict of October 26, 2023, the Supreme Court of the canton of Zurich upheld the attempted murder of two police officers and various other crimes. Aged 20 at the time of the events, the driver had forced a police barrier set up for him using a stolen car. One of the agents had been violently hit and the other had narrowly escaped the impact.

In a judgment published Monday, the Federal Court rejects all of the appellant’s complaints. He claimed that he thought he could escape by climbing onto the sidewalk. When he saw at the last moment that the police were there, it was too late to avoid them.

For the Mon Repos judges, the assessment of the previous instance is not arbitrary. The expertise showed that approximately 3 seconds had elapsed between the condemned man’s rushing start and the collision with the policewoman. With the exception of a hesitation of 4 tenths of a second, it had continued to accelerate.

The fact that the police officer, who already had her pistol in her hand, fired a shot is not decisive. This uncontrolled shooting can only be interpreted as a reflex showing that the agent did not have time to concentrate and realize the danger for her.

The 2nd Court of Criminal Law also confirms the assassination by possible fraud held by the Zurich justice system: the young man did not want the police officers to die but, by speeding off and passing along the sidewalk where they were, he is accommodated to the mortal risks he posed to them.
