Abdellah Bouanou, the head of the parliamentary group of the Justice and Development Party (PJD), recently sent a letter to the President of the House of Representatives, Rachid Talbi El Alami, requesting the opinion of the National Commission for Control of protection of personal data (CNDP) on the code of criminal procedure.

After requesting the opinion of the Economic, Social and Environmental Council (CESE), the National Human Rights Council (CNDH) and the national body for probity, prevention and the fight against corruption (INPPLC) on the code of criminal procedure, the PJD parliamentary group recently questioned the CNDP on this same question.

The PJD parliamentary group requested that bill No. 03.23 amending and supplementing Law No. 22.01 relating to the code of criminal procedure be submitted for the opinion of the CNDP.

This request was raised in a letter sent by the president of the group, Abdellah Bouanou, to the President of the House of Representatives. In this letter, Bouanou refers to the provisions of Article 24 of the Constitution and Article 27 of Law No. 09.98 relating to the protection of individuals with regard to the processing of personal data, which stipulates that the Commission is responsible for giving its opinion to Parliament on the draft laws relating to the processing of personal data submitted to it.

In his question to Rachid Talbi El Alami, Bouanou stressed that “the code of criminal procedure is legislation of great importance in achieving a balance between the power to punish and the guarantee of protection of the rights and freedoms of individuals”. This requires, according to the head of the PJD group, an update of the national criminal policy, in order to ensure the protection of society and guarantee its security and stability, as well as the adoption of legal measures and procedural rules which follow developments in Morocco after the 2011 Constitution, as well as changes affecting the criminal justice system at the national and international level.

He added that the CNDP plays a crucial role in verifying personal data processing operations in a legal manner, without infringing on privacy, fundamental human rights or freedoms. Its mission is also to inform and raise awareness among individuals, public bodies and private institutions, by guiding and directing people to protect them against any misuse of their personal data, and by raising awareness among public and private entities of the obligations imposed by law and best practices in the processing of personal data.
