A judge in Fulton County, Georgia, has declared the southern state’s law banning abortion after the sixth week of pregnancy unconstitutional. Judge Robert McBurney’s decision on Monday therefore authorizes abortions in the Peach State to be performed as they were before the LIFE law came into force in 2019, that is to say until approximately 22 weeks pregnant.

“A review of the interpretations of the concept of ‘liberty’ by our superior courts shows that liberty in Georgia includes in its meaning, in its protections and in its set of rights a woman’s power to control her own body, to decide what happens to him and his body, and to reject state interference in his health care choices,” Justice McBurney ruled. “This power is not unlimited, however. When the fetus developing inside a woman reaches viability, when society can assume care and responsibility for this separate life, then – and only then – can society intervene. »

It is expected that this decision will be appealed by the State of Georgia. In the meantime, Georgia becomes the only Southern state besides Virginia where women can obtain an abortion until the fetus is viable.
