By an order dated November 28, the summary judge of the Administrative Court of Pau suspended the decision of the rectorate of the Bordeaux academy, dated September 9, prohibiting Christian Espeso from exercising the functions of management of an establishment of private education, for a period of three years.
The director of the Immaculate Conception school in Pau was accused of three series of breaches. First, the ignorance of the principle of secularism for having authorized the provision of a course entitled “religious education”, and the organization of a march from Pau to Lourdes which would have a religious dimension. Then, the lack of knowledge of programs and educational freedom. Finally, the inappropriate behavior of the person concerned: making violent remarks towards certain members of staff and practicing malicious management.
The judge in summary proceedings justified the suspension of the rectorate's decision by the existence of an emergency situation due to a risk of dismissal and its impact on his personal situation, and because of a serious doubt as to the legality of the act, deemed disproportionate to the fault.
This suspension of the sanction therefore applies until the trial judge, ruling in collegial formation, rules on its legality.
