The State was ordered by the administrative court of appeal to pay €88,000, in reimbursement of compensation paid to the family of a man killed by fellow prisoners, in , indicates theAFPthis Thursday, November 28, 2024.

A young prisoner victim of lynching

On December 16, 2017, a 20-year-old prisoner was the victim of lynching by five fellow prisoners, in a walking courtyard at Baumettes prison. He died weeks later from his injuries.

The five prisoners involved were sentenced in 2020 to sentences ranging from 14 to 20 years of criminal imprisonment.

The victim’s family members had appealed to the administrative court for the State to compensate them for “their moral damage”. The request was rejected, the relatives then appealed to the administrative court of appeal.

“The prison administration must provide protection”

This recalled, in a judgment of November 25, that “the prison administration must provide each detained person with effective protection of their physical integrity”.

She also estimated “that there is good reason to set the compensation for the mother’s loss of affection at €30,000”, just like for the father, and €14,000 for each of his brothers “given their young age”.

The court then specified that these sums must be paid by the State to the Guarantee Fund for Victims of Acts of Terrorism and Other Offenses, which had already compensated the family.
