The Pitangui District Court partially accepted, this Tuesday, December 10th, the requests from the Public Ministry of Minas Gerais (MPMG) made in action against Jaguar Mining, due to the landslide of the waste disposal pile and waste from the Turmalina Mine , which took place in the municipality of Conceição do Pará.
The decision obliges the mining company to halt the operation (except those necessary for safety and monitoring) of the Satinoco Pile, the tailings dam (Tourmalina Dam), the processing plant and three secondary deposits that make up the project, until proof of stability and security of all structures by independent technical audit.
The document also provides for the adoption of all technically necessary emergency measures to diagnose, control, monitor, mitigate damage and begin the recovery of socio-environmental damage caused by the transportation of materials. And the elaboration, within a maximum period of 48 hours, of a special communication plan about the safety conditions for the affected community.
In the decision, the judge determines that Jaguar Mining adopt all necessary measures to support the evacuated population, including immediate payment, as emergency aid, in the amount of R$ 10 thousand reais for each family nucleus that was removed from their property , as well as monthly payments for the duration of the evacuation. The measures must be complied with in full, under penalty of a daily fine of R$50,000.

Understand the case
As widely reported in the press, a slope in the waste disposal and mining waste pile (Satinoco Pile) failed. The wave of sediment and waste reached part of the structure used by the company in mining activities, causing serious socio-environmental damage, and also traveled approximately 250 meters until reaching the area of the rural community of Casquilho. 69 homes were closed and 134 people in the community were evacuated by the company.
In addition to the technical team from the Center for Combating Environmental Crimes (Nucrim), from the Public Ministry of Minas Gerais, the Military Environmental Police and the Fire Department were on site and confirmed the serious socio-environmental and socioeconomic damage caused by the rupture of the pile of rejects.
