In dire straits, the Montois found no other solution than to take legal action against his dealer who did not want to hear about a replacement not of the engine, but of the vehicle. “Despite the experts I hired who attested to the problem, nothing helped, the manufacturer didn't want to hear anything so I had no choice. This resulted in tens of thousands of euros in legal, procedural and expertise costs, out of my pocket but also that of my insurer who fortunately protects me very well legally and who follows me. For several years, I was also forced to rent another vehicle because I no longer dared to drive my car too much..”
The current situation is desperate for Karim. “I still own my vehicle, which now has 200,000 km on the clock, but the noise is still present. In addition, as the engine has been replaced, I can no longer resell it to a garage and, as the noise is still present, I cannot resell it to an individual either. My only solution is for the manufacturer to recognize the problem and agree to replace my vehicle.”
This Friday, the Mons company court, based on the expert report ordered by Karim, appointed a new expert who will be responsible for determining exactly the problem with his car. “I really hope this ends up being successful. Because this situation, in addition to costing me money, caused me a lot of stress. A stress that I would have gotten over.”
The expert's report should arrive in the coming months, by the spring, in the hands of the judge.
