Convicted of negligent homicide for shooting a biker, a former bus driver challenged his judgment all the way to the Federal Court, without success.
As a reminder, at the end of September 2020, a bus driver blew a “Stop” signal and hit a young man who was riding a motorcycle on the cantonal road between Cossonay and Dizy. The latter lost his life in the accident.
In February 2023, the Criminal Court of the La Côte district found the man guilty of negligent homicide and sentenced him to a monetary penalty of 150 days fine at 60 francs per day, suspended for 2 years . Decision confirmed on appeal by the Vaud Cantonal Court, September 21, 2023.
However, nothing happens. The ex-driver refuses his sentence a second time: according to him, other factors should have been taken into account by the authorities to assess his responsibility, such as the speed at which the 18-year-old motorcyclist was traveling. The argument, already dismissed by the cantonal court, does not convince the federal court either, which considers that even if the victim drove above the authorized limit (which is 80km/h at this location), the violation of the sign ” Stop” remains the main cause of the accident.
The appeal was once again rejected by the courts and the former driver therefore saw procedural costs of 3,000 francs added to his conviction.
