TRIBUNE – On November 21, the International Criminal Court issued an arrest warrant against Benjamin Netanyahu for war crimes and crimes against humanity. A decision which is based on a misinterpretation of its sphere of competence, analyzes lawyer Noëlle Lenoir.

Often criticized for its inefficiency, its politicization and its particularly high operating costs, the International Criminal Court (ICC) has just crossed a point of no return. By authorizing on November 21, 2024 Karim Khan, his prosecutor, to issue an arrest warrant for war crimes and against humanity, in the context of the Israeli-Arab war in Gaza, against Benyamin Netanyahu, the Prime Minister of Israel and Yoav Gallant, its former Minister of Defense and at the same time against one of the most bloodthirsty terrorists of Hamas – moreover probably dead – Mohammed Deïf, the preliminary chamber of the Court, far from doing progressing the fight against impunity indirectly supports the most barbaric tyrants by weakening democracies. The institution which owes everything to democracies, including France in particular, thus bites the hand of those who held it…
