Kylian Mbappé admitted to having had sex with a Swedish woman. A consensual relationship, according to the Real Madrid star, except that consent in Sweden does not have the same meaning as in France. Without explicit agreement between the two people, rape can therefore be committed.
Kylian Mbappé facing rape accusations, the epilogue continues. Two versions clash. On the one hand, that of the Swedish press, convinced that the French football player is directly targeted by a rape complaint. On the other, the Mbappé clan, which refutes these accusations and denies it outright. What if both camps were ultimately right? Because the legislation regarding rape in Sweden differs completely from what is said in the French penal code.
Rape by negligence
To understand, we have to go back to 2018, after the MeToo era, when Sweden changed its law. The country then creates rape through negligence. “Even without threats and even without violence, since consent has not been clearly expressed, a person can find themselves subject to this offense,” explains Me Pauline Baudu-Armand, lawyer at the court.
Without explicit agreement between the two people, rape can therefore be committed. Which complicates the defense of the French footballer. “So that Kylian Mbappé is not worried in this story, he, or whoever, will have to demonstrate that this young woman had expressed her consent in any way such as by means of written exchanges or audios”, specifies the lawyer.
Kylian Mbappé claims to have text messages proving the young woman’s consent. Messages which will surely be requested from him during a possible summons to face Swedish investigators. In this case, the former PSG player faces up to four years in prison.
