THE State Council rejected the appeal of a Parisian notary, who opposed the construction of thirteen social housing units and two homes for childminders (MAM) in the 7th district from Paris. A building permit now final

In this case, the mayor (PS) of Paris, Anne Hidalgo, had issued in August 2022 a building permit to Batigere, a Social Enterprise for Housing (ESH), which presents itself as a “citizen landlord”. The notary, however, managed to have this building permit suspended by the summary judge of the Paris administrative court in July 2023.

“These two childminder houses will be installed after disbursement of the land, […] they will have a mezzanine, but […] children will only be accommodated in the lower part of the premises, on the ground floor,” the judge explained at the time.

The three companies of the Parisian notary and his neighbors co-owners of the Haussmann building at 29, boulevard de la Tour-Maubourg were then disavowed on the merits by the Paris administrative court. They then filed an appeal before the Council of State.

“The administration had information according to which the realization of the project required authorization from the owners of the neighboring building,” maintained Me Sylvère X. before the highest French administrative court. “The Paris administrative court committed an error of law by holding that childminder homes do not constitute housing. » Above all, the two MAMs will “seriously undermine the lighting conditions” of its housing.

But “none of these means is likely to allow the appeal to be admitted”, concludes the Council of State in a judgment of October 25, 2024, which has just been made public. The building permit for thirteen housing units and two childminder houses is therefore now final.
