The column has been fueled for several days by a story of complaint filed by the former gendarmerie commander Ibrahima Dramé against the former high commander of the gendarmerie, director of military justice, General Moussa Fall. To understand this series, opened in the public square, Dakaractu goes back in time to shed a little light on a subject which challenges by recalling the serious and consistent facts which highlight the practices of a former constabulary officer at the heart of the turmoil.
In 2022, the gendarmerie services received several people who came to complain about the actions of a senior officer (Ibrahima Dramé) stationed at the personal staff of the President of the Republic (at the Military House). The latter say they are victims of visa and land fraud. Their interlocutor remains owed them several tens of millions of FCFA. Faced with the seriousness of the accusations, the senior authorities of the gendarmerie sought to understand what was really happening. Given the amounts involved, it was impossible to make a payment internally. This is why the gendarmerie hierarchy seized, through a letter addressed to the commander of the territorial gendarmerie, facts of alleged fraud concerning a gendarme. Thus, the head of inspection of the gendarmerie services was informed in writing. This allowed him to open an investigation, the subject of which is the complaint against squadron leader Ibrahima Dramé for fraud to the detriment of eight people.
The work of the gendarmerie services inspection
The investigation carried out by the gendarmerie inspection is divided into two groups whose work will provide a clear idea of the accusations made by the complainants.
There is the alleged visa scam. Four people denounced the actions of Commander Ibrahima Dramé before demanding their dues. On the land, four other people filed a complaint before the senior authorities of the gendarmerie.
Revelations from Canada’s visa investigations…
Ibrahima Dramé, who was on duty at the EMPAT (military house), spoke to Abdou Ndoye, a security guard in the vicinity of the Palace on a trip to Canada organized by the Gendarmerie according to him… Moreover, there had places to fill. He had the possibility of finding him a visa for Canada… Mr. Ndoye, who is one of his acquaintances, declined the offer and put him in touch with a person named Ibrahima Guèye who would later remit the sum of 2,650 .000 FCFA francs to Mr. Dramé… Ibrahima Guèye involves Moustapha Guèye who pays 1,400,000 FCFA francs… another person by the name of Yara Ndour will give 2,500,000 FCFA francs and Alioune Badara Fall (2,500,000 FCFA francs), i.e. a total amount of 9,050,000 FCFA francs for visas during the investigation by the gendarmerie services inspection.
To give more credence to his actions, the transactions took place on the premises of EMPAT. However, tired of waiting for visas, the complainants contacted Commander Dramé who explained to them that there were Malaysians who were to take part in the trip and who had not yet arrived on Senegalese territory. This would explain the delay in issuing visas.
…on land
Three police officers and a contractor are the alleged victims of squadron leader Ibrahima Dramé. These are the police adjutant Cheikh S. S, one of his relatives (5,300,000 FCFA francs), Jean Pierre ND. also a police adjutant (4,300,000 FCFA francs), the police officer Kalidou D (2,350,000 FCFA francs) and the entrepreneur Mamadou Diop (22,300,000 FCFA francs)…
Investigators from the gendarmerie services inspection say that the elements received are only the visible face of the iceberg. They calculated damage of 43,300,000 CFA francs. Moreover, the latter are unequivocal about the behavior of the police officer in question: “Use of fraudulent means to obtain money. He also abused his position as a gendarmerie officer to orchestrate a plot, a staging, and extract money from individuals.”
“He had no mandate to speak or act on behalf of the cooperative. »
Lieutenant-Colonel Cheikh Faye, director of the gendarmerie housing cooperative from 2012 to 2020, explains to the inspectorate of gendarmerie services: “Commander Dramé was never part of the board of directors of the gendarmerie. housing cooperative of the National Gendarmerie (COHAG) even less of its staff… he had no mandate to speak or act in the name of the cooperative… Commander Dramé had applied to benefit accommodation, but he did not pay the personal contribution. After several formal notices, he will be excluded from the program and the accommodation reassigned to another person…
Proposals from the gendarmerie services inspection
The investigators, at the end of their work, made two proposals (sanctions) to their hierarchy:
Disciplinary (for misconduct against the honor, probity and general duties of the soldier as provided for by article 80 of decree 90-1159)
Criminal (commission of acts constituting fraud under the conditions defined by article 379 of law 65-60 of July 21, 1965 relating to the penal code)
The report strongly advises the hierarchy to ask the complainants to take legal action. And that Commander Dramé be brought before a disciplinary council.
The order is transmitted from the prosecutor, the mandatory arrest and the entrance exam to the war school.
Complainants, following the denunciation before the high authorities of the gendarmerie, submitted complaints to the prosecutor against the actions (alleged fraud) of squadron leader Ibrahima Dramé.
To see clearly, the prosecutor entered the research section with transmitted documents, including those with the numbers 1397 and 1609 from the Dakar public prosecutor's office. This approach made it possible to see that:
In addition to the eight people identified by the inspection of the gendarmerie services, other victims (17) reported themselves to the public prosecutor's office. There is among them, a lady, Mariama Diatta, a certain Mory Camara, Mouhamed Ndiaye and another by the name of Jean Abraham Sow, as well as six other plaintiffs: Mouhamed Diallo, Habib Kébé, Mbaye Dionne, Assane Sow, Mactar Sylla , El H Abdou Ndiaye;
The overall amount of sums claimed thus increased from 43.300.000 CFA francs to 63.300.000 CFA francs for the alleged crimes of land fraud and attempted migrant smuggling.
At the same time, a disciplinary procedure had been initiated by the gendarmerie… and Commander Dramé had received 45 days of rigorous arrest… Then the procedure for his removal was initiated before being pronounced, according to the texts of the gendarmerie. This is what prevented him from taking the entrance exam to the war school. Because, to be eligible, you must not be placed under arrest during the three years preceding the competition.
The prosecutor had requested in the transmitted “investigation and hearing”, if the facts are proven, an arrest. Which was done. But he will benefit from the presidential pardon (Macky Sall) on December 31, 2023.
The complaint by the gendarmerie lawyer against Ibrahima Dramé following threats against 3 senior gendarmerie officers
Upon his release from prison, Ibrahima Dramé sent a message via his personal number 77 516… to Colonel Abdou Mbengue. “Thank you for everything. I wouldn't waste my time looking for work, I would go where I can use weapons, because I was trained for that… Come what may” he wrote.
Then will follow a second message sent to colonel Cheikh Faye. “You are proud to help carry out the dirty work of Moussa Fall, the executioner of the sons of Casamance. One thing is certain Salif Sadio will not be more Casamance than me” he says.
Finally, a final message will be sent to General Moussa Fall “I know the name of your wife, your son and your relatives… If Senegal does not need me, Casamance can welcome me with open arms because I have been trained in the use of weapons ”.
Thus, the Gendarmerie lawyer, Me Baboucar Cisséwill be activated. He will file a complaint on 01/10/24. Two days later, the prosecutor took up the complaint (01/12/24) and asked the Dakar research section, via a transmission, “for an investigation and arrest, if the facts are proven”.
Missing for a while, Ibrahima Dramé will be arrested by the Ziguinchor research section on 02/24/2024 around 5:30 a.m. in the Mandégane village in Ziguinchor, then sent the same day to the Dakar research section around 4:30 p.m. H.
During his hearing at the research section, the former squadron leader beat his chest before declaring that he was angry, which is why he sent these messages to senior officers of the gendarmerie . “In view of all the difficulties I had in prison, there was a feeling of disappointment and abandonment which pushed me to act in this way. I had no intention of harm… My parents asked me not to do that again and to move on… If these people feel they have been offended, I apologize to them, he defends himself… The investigation concluded on 02/26/2024, it is referred to the prosecution.
After his face-to-face meeting with the prosecutor, he is placed under arrest and his file is sent for investigation…
About torture…
Nowhere in his statements to investigators did former commander Dramé mention any mistreatment or torture, according to a well-informed source. “He had been treated properly by those who arrested him and transported him to Dakar. He never questioned the report which he signed.
“His referral to justice through a complaint does not make sense”, according to a legal expert contacted. In this case, he had to contact the judge responsible for his case to inform him of his elements, because he is under investigation.
