The appeal against the partial free TPG is rejected

This is a second disappointment for Yvan Zweifel and Adrien Genecand, the two PLR elected officials having filed as citizens an appeal against the partial free TPG. Because after refusing the suspensive effectthe Constitutional Chamber of the Geneva Court of Justice ruled their appeal inadmissible on the merits.

Free admission for young people up to the age of 24 (subject to training and income) and the half-price for AVS and AI beneficiaries can therefore come into force as planned on 1is January. The appellants can, however, appeal to the Federal Court.

In a press release, the Court of Justice wrote: “The appellants do not have the standing to appeal against the disputed cantonal law which, after analysis, does not violate the Federal Constitution. The advantage that this law grants to young people and AVS/AI beneficiaries does not, as it stands, result in any direct and personal disadvantage for the appellants, even in the future.”

Middle class

The press release recalls that the federal standard stipulates that the prices paid by users must cover an appropriate share of costs. But a wide margin of appreciation is left to the cantonal legislator, adds the Court. This rejects the appellants’ argument, essentially based on a legal opinion mandated by the Federal Office of Transport.

On the other hand, it confirms the “nuanced and differentiated solution of the Geneva legislator” which distinguishes the situation of retirees and young people. For the former, reducing the price is considered compatible with the Federal Constitution. Same conclusion for young people.

As a reminder, the Council of State, in the person of Pierre Maudet, proposed free admission for young people, but the Grand Council voted for this law by adding the half-price for beneficiaries of AVS and AI .

“I fought to carry out this project for the middle class, which aims to reduce household budgets,” says Pierre Maudet via his spokesperson Sophie Davaris. I am pleased that justice confirms that everything was done according to the rules.”
