The village chief of Keur Mbaye Maty, Mamadou Gueye, aged 83, died on December 12, 2024, following his placement under committal order.

His lawyer, Me Maguette Sène, clarified his imprisonment, which he describes as excessive given the very advanced age of the deceased.

Their request for provisional release was rejected. However, he asserts, in judicial practice, defendants prosecuted for illegal occupation generally appear at liberty.

UPDATE ON INMATE MAMADOU GUEYE, AGE 83, DEATH IN DETENTION (Me Maguette SENE)

Everything was started by his half-brother Massamba Gueye who had filed a complaint against him.

The Thiès public prosecutor’s office transmitted it to the DSCOS in Mbour which interviewed our client on September 10, 2024 on an alleged illegal occupation of land. In this regard, the village chief of Keur Mbaye Maty, namely Mamadou Gueye, denied all the facts alleged by his half-brother.

To the Subsequently, on November 20, 2024, on instructions from the public prosecutor’s office, he was summoned and taken directly to be referred, despite his very advanced age (83 years) and his status as village chief.

Curiously, the same day, he was placed under arrest warrant to be tried at the flagrante delictos hearing of the TGI of Thiès on December 6. On this, the prosecution retained the offenses of illegal occupation of land belonging to others, violence and assault.

Worse still, what shocked the public was the excessively advanced age of the defendant who struggled to stand at the bar of the Court with his cane.

It should be noted that in practice, the offense of illegal occupation for which he is being tried does not warrant a committal warrant.

There are thousands of defendants who appear freely at criminal hearings for this offense.

At the end of the hearing, the case was adjourned to December 13 for deliberation.

As a result, we lawyers, namely Me Cheikh Tidiane Mbodji and myself, made a request for provisional release by drawing the attention of the Court to the very advanced age of our client and to his state of health incompatible with prison life.

However, the prosecution objected and the Court rejected it.

Unfortunately, the day after the said hearing, old Gueye was urgently transferred to the Thiès regional hospital following a seizure he suffered.

He died on December 12.
