It was around 9 p.m. that the police were called. After seeing a “ crying lady», scantily clad in the street, a passer-by raises the alarm. Upon arriving on site, the police confronted a victim of domestic violence. The woman explains that earlier in the evening, an argument broke out between her and her partner.

After drinking a liter of vodka, the man flew into a rage and carried out blows of incredible violence: “ slaps on the back », « fingers buried in eyes» or even a “remote control stuck in mouth» to the point of suffocation. “I’m going to knee you in the mouth, you can die,” the 36-year-old man also said before “tearing the t-shirt” of his partner. The latter admits that fleeing was “her only option to escape”. Facts that the defendant describes as “barbaric” although he says he does not really remember them.

The president of the court hardly believes it: “You forget the most serious elements”. The latter underlines “very significant violence that we do not see in all the files. »

In court, both spouses are crying. The victim describes a “very dangerous individual” and denounces violence against a background of alcohol “recurring for two weeks”. The 36-year-old apologizes and maintains: “I will change, I will always be there for her. » But if the victim says they are “afraid of reprisals”, they do not want him to go to prison.

According to her, her partner only “needs care”: “He is only violent when he drinks,he’s a teddy bear when he doesn’t drink. » She even adds that she doesn’t blame him: “I’m alive, that’s the main thing. »

“I am not a doctor, I am not here to treat you”

The victim’s lawyer denounces “serious facts” but decides “not to overwhelm [le prévenu] out of respect for [sa] customer”. She only asksSymbolic 1.50 euro compensation. A boon for the defense lawyer who paints the portrait of “someone adapted, aware of his problems”, with a “stable situation”. She pleads a “depressive period” because of which her client has “no more self-esteem”.

According to her, the 36-year-old man reproduces a pattern he experienced when he was little: “He was punched by his father, a top boxer. » The lawyer then asks the court to consider a sentence modified using an electronic bracelet.

For the prosecutor, “it’s a bit easy not to remember the facts”. According to her, the 36-year-old man “removed responsibility” by blaming his alcohol problem and did notno “awareness”. “How many victims will it take for you to recognize your responsibilities? », she blames.

Indeed, the defendant was already convicted in February 2023 for similar acts against his previous partner and since 2016, he has had a string of convictions for violence. If the prosecutor concedes that the man needs care, she nevertheless recalls that her role is to “sanction”: “I am not a doctor, I am not here to treat you. » It therefore requires24 months of imprisonment, six of which were suspended on probationas well as a ban on contact with the victim.
