In eight judgments, “the court held that the refusal of recruitment, or the recruitment of a person other than the agent in office for several years, was illegal due in particular to the manifest inadequacy between the profile of the candidate selected and the one sought to occupy the position for which he was recruited”. This led to compensation (between 6,000 and 10,000 euros) and, when requested, to cancellations.

“If the question was also raised, by the applicants, of the possibility of a misuse of power, of discriminatory treatment for the benefit of people with political affinities or family ties with regional elected officials, or even of a taking illegal interest, the judgments were not located on one or other of these grounds to enter into the process of annulment or condemnation”, specifies the court.
In ten other judgments, it was noted, in the implementation of the recruitment procedure, an irregularity of a certain seriousness, the formalities of the pre-selection and the recruitment interview not having been completed in accordance with the rules applicable. This led to compensation (up to 2,000 euros) and, when requested, cancellations.
