According to the online media, it was in March 2024 that the public prosecutor of Saint-Denis opened a judicial investigation following a complaint.
– Eviction of agents: the Region ordered to pay compensation by the administrative court –
The case was also brought before the administrative court in March, for evictions at the start of 2022 against 28 agents of the Regional Council engaged under fixed-term contracts (CDD) – who occupied high schools in high schools. positions of multi-purpose agent, computer maintenance agent or facilitator within the framework of the “laptop computer plan” (POP) system and who, at the end of their contract, have not been renewed in their functions.
In these judgments, “the court then found that the Réunion region had been able to legally launch a recruitment procedure for each of the permanent jobs hitherto occupied by the applicants under a fixed-term contract”, specifies the court in a press release.
In eight judgments, “the court held that the refusal of recruitment, or the recruitment of a person other than the agent in office for several years, was illegal due in particular to the manifest inadequacy between the profile of the candidate selected and the one sought to occupy the position for which he was recruited”. This led to compensation (between 6,000 and 10,000 euros) and, when requested, to cancellations.

“If the question was also raised, by the applicants, of the possibility of a misuse of power, of discriminatory treatment for the benefit of people with political affinities or family ties with regional elected officials, or even of a taking illegal interest, the judgments were not located on one or other of these grounds to enter into the process of annulment or condemnation”, specifies the court.
In ten other judgments, it was noted, in the implementation of the recruitment procedure, an irregularity of a certain seriousness, the formalities of the pre-selection and the recruitment interview not having been completed in accordance with the rules applicable. This led to compensation (up to 2,000 euros) and, when requested, cancellations.
