Finally, Christina, the mother of the very premature baby taken from her incubator on October 21 at the Aulnay-sous-Bois maternity ward in Seine-Saint-Denis will remain free under judicial supervision. The investigating chamber of the Paris Court of Appeal confirmed this decision on Tuesday, reported The Parisian.

The mother was unable to attend the hearing before the investigating chamber on Tuesday, November 19, which was to rule on her fate. And for good reason? She was admitted on November 9 to a psychiatric establishment in Ile-de-France to wean herself off cannabis, as she had undertaken to do during her placement under judicial supervision. “She wanted to come, but the doctors refused to let her out. She was in no condition”confided the parents of the young 25-year-old mother, who traveled to the Paris Court of Appeal.
The JLD decision ratified
The judge of freedoms and detention of the judicial court of Bobigny (Seine-Saint-Denis) had refused to place the young woman in pre-trial detention, against the opinion of the investigating judge of the prosecution who had appealed the decision . In vain, since the Paris Court of Appeal finally upheld the JLD's decision. “I learned of the decision of the court of appeal, which did not want to send the police to look for a mother in a hospital. Christina, for me, is only guilty of one thing: having loved her son too much”reacted the young woman's lawyer, Me Romuald Sayagh, contacted by our colleagues.

Santiago, a very premature baby born two months premature, was taken from his incubator by his parents on October 21 when he was only seventeen days old and required constant care. The parents, Christina N and Kévin D, feared the child would be placed in care because of the mother's addiction to cannabis, and fled with their baby. A kidnapping alert was immediately issued by the courts.
The father, still in detention
The parents were eventually found with their infant in the Netherlands, in a hotel room in Amsterdam and were taken into custody. Only the mother accepted the simplified surrender procedure to the French authorities. She was presented on November 7 after her arrival in France to a French investigating magistrate and was indicted for kidnapping a minor under the age of 15 in an organized gang and deprivation of care by her ascendant. The father, for his part, is still incarcerated in the Netherlands. His extradition request will be examined in the coming months by the International Judicial Assistance Chamber (IRK) of the Amsterdam court.
