A 24-year-old man was tried immediately, this Wednesday, June 26, for a series of offenses committed at the beginning of the week in Roannais.

It is a veritable marathon of delinquency undertaken by a 24-year-old man, who arrived in Roanne a few days ago from Lyon. Father of a little girl aged 25 days, the individual came to Roanne with his wife to find accommodation, when their daughter was taken from them and placed in a nursery. Already convicted three times for attempted break-ins, his last conviction dates back to June 2022 in Nice.

The individual did it again on the night of June 24 in Roanne. Around 1:30 a.m., the man broke the window of an apartment to gain entry. One of the owners then puts him on the run.

Spitting aimed at a police officer

Arrested shortly afterwards, he admitted the facts, but denied having wanted to steal, wanting instead, according to him, to take shelter in a dwelling that he had been told was squatted. Released with a summons from the courts, he was in the news again the following night.

On June 25 at 3 a.m., at Coteau, the accused called BAC agents to ask them for a cigarette. Surprised by the approach, the police decided to follow him and caught him opening a car and searching it. The police decide to check him but the individual, smelling strongly of alcohol, provides them with a false identity, so he is arrested.

Insults are thrown, the individual refuses to submit to a blood alcohol test and a medical examination. The latter spits at a police officer. According to the latter, the defendant even tried to knee him in the private parts.

The defendant admits to almost all of the facts alleged except for the attempted knee strike. He argues that he thought he knew the owner of the car and that he hoped to find cigarettes in it. Regarding the insults, he considers that the police officers were contemptuous. In response, he allegedly decided to “annoy” them, in the words of the deputy prosecutor, by giving them the wrong identity.

A defendant in a precarious situation

The latter requested a sentence of 14 months in prison, six of which were suspended for two years, and detention for the remaining eight months. The defendant’s lawyer, Me Élisa Leca, pointed out the great precariousness of her client’s situation, the pressure placed on his shoulders and the pressing situation given the recent birth of his daughter. In this sense, the lawyer asked not to issue a committal warrant and to adapt the quantum of the sentence.

I deeply regret this whole situation. I apologize to anyone I may have harmed or offended. I realize the seriousness of these actions.

Finally, the court sentenced him to a 12-month prison sentence, including four months with a committal warrant, but in the form of semi-release. The remaining eight months of the sentence are accompanied by a probationary suspension with various obligations: to work, to receive treatment and to pay damages to the victims (300 euros).
