The hearing took place on September 3. The applicant requested from the administrative court the annulment of a decision of the Ministry of the Armed Forces dated June 7, 2023 refusing his resignation. First arguments invoked, a commitment period of six years which linked him to the air force “exceeded since August 2017”, a “duty accomplished” and officer missions which “infringe his private life and family, as well as his freedom.
“General considerations”
What followed took a toll on the Air Force: “degraded working climate and infrastructure”, not to mention that “it was up to the human resources department to anticipate departures”, argues the person concerned, who goes as far as say they are “unmotivated”, “which can present a danger for the use of fighter planes which require great concentration”.
The first chamber of the administrative court, however, rejected the request. “The resignation of a career soldier, when the person concerned is not placed in a situation allowing him to benefit fully from this resignation, is subject to the approval of the Minister of the Armed Forces, taking into account the interest of the service. »
