At the end of July 2023, Emma presented herself with her mother to the La Ferté-sous-Jouarre gendarmerie to denounce Alain’s actions. She immediately clarified that this concerned words and writingsbut in no case gestures.

A year earlier, she accompanied him during each summer vacation weekend to sell pancakes in Paris. At first, they joked a lot but very quickly, the tone changed. The remarks became more serious and very sex oriented. At the end of the season, the words were followed by messages that the young girl first considered as a game. So, she responded in the same tone. But soon after, a new step has been taken with sexualized remarksrequests for naked photos…

When she confided in a friend, she was initially surprised by the behavior of a man of that age before expressing her concern. His reaction prompted Emma to tell her mother who immediately reacted by forbidding Alain from any contact with the family and closing the door to their house on him.

After filing a complaint, Emma was examined by a psychologist from the Medical-Judicial Unit (UMJ). He noted strong anxiety at the idea of ​​seeing Alain again and granted him two days of total incapacity for work (ITT).

“I have been diagnosed with HPE, I am unable to say NO to someone”

At the hearing, Alain repeated the statements made in police custody, always seeking to give the best image of himself, firstly that of the helpful friend : “I took her with me to Paris as a favor to her parents and because she was bored. Her father wanted her to keep busy during the summer and was sometimes violent. Her mother never missed an opportunity to demean her because of her unattractive appearance.”

Then that of understanding uncle and open-minded who, without waiting to be questioned, continued without failing to incriminate the teenager: “All her conversations revolved around sex, even pornography! She made unfiltered reflections after male customers passed by or as soon as she saw a man. I got into her game. I was diagnosed with High Emotional Potential (HPE) and I am incapable of saying NO to someone, except when she offered me €20 to give me oral sex. I am also on psychological disability.” To give credibility to his words, Alain asked to read Emma’s last message received on Facebook before blocking her: “You’re the adult! You should have set limits when I go too far! “.

This last sentence, read by Alain, did not have the desired effect. On the contrary, it constituted an excellent springboard for the judge : “This is exactly what you are accused of! “.

Before giving the floor to the representative of the public prosecutor for her requisitions, Alain, in his role of victim, wanted to add: “ I no longer have contact with this family who disrespected me! Emma is trying to make me look like a pervert! Either way, I will appeal the decision. I will bring new elements to defend myself! “.

“A denial of justice and not empathy!” »

The first words used by the public prosecutor were enough to know that she had no doubt about Alain’s guilt: “ Your positioning is a denial of justice and not empathy! Your words are intolerable! “. To illustrate her appreciation, she even cited a new sentence taken from the messages exchanged: “I would like to give you a hug – No, you are going to touch your box!” “.

Alain received six months in prison with suspended probation for a period of two years during which he must submit to the ban on contacting Emma and her parentsto appear at their home.

He must also follow psychological care and complete an internship on sexism. For five years, he will not be able to carry out any employment or any activity in contact with minors. And finally, his name will be included in the sex offender file (FIAIS).
