When he is at rest, this inhabitant of Torcy-le-Petit (Seine-Maritime), placed under electronic bracelet, can only leave his home between 8 a.m. and 1 p.m. But on Thursday April 25, 2024 at the beginning of the afternoon, an alarm sounded at Spip, the prison integration and probation service.

The 35-year-old man was not at home. And it was only after 10 p.m. that he voluntarily presented himself to the gendarmerie.

Friday April 26, he had to come and explain himself before the Dieppe court for these facts described as an escape.

He says he had just been released from prison and was serving the end of it in the form of house arrest. He only had a few days left to perform. As soon as he was released from prison, he found work.

He had gone to Paris

But it is 50 minutes by bike from his home and he works from 8:15 a.m. to 8:15 p.m. with a break during the day. In the absence of a vehicle, he must remain on site.

To make his travels easier, the defendant wanted to buy a scooter. But his means did not allow him to spend more than €700. At the start of the week, he explained his research to his integration and probation advisor. “I said that I had a possible sale in Canteleu and one in Paris. Spip told me that it was better in Canteleu,” he explains.

However, this possibility fell through and it was only in Paris that he found a two-wheeler affordable to his finances. “But your advisor didn’t tell you not given permission to go there,” the judge pointed out to him.

He refuses to turn around

He thought he was in his right. During a previous electronic bracelet measurement – ​​this is the third house arrest he has been under – he says he already provided proof of absence afterwards. And that’s what he intended to do: when he returned, bring back the proof of purchase.

He admits that he has “ forgot to call Spip » to confirm that he was gone to Paris. The situation became even more serious when his advisor contacted him at 2 p.m. to find out where he was, he raised his voice and refused to turn around to go home. “I lost my temper,” he explains.

“My temper has calmed down”

The magistrate recalls that in previous reports, his impulsiveness is already highlighted and the fact “that he does not respect the framework”. He puts this down to the cannabis he used every day for 17 years. “It had an effect on my mind, I was execrable. But I no longer smoke and my temper has calmed down,” he says. Which the judge doubts.

The deputy public prosecutor requested a five-month prison sentence against him with a warrant of committal. The defendant’s lawyer asks to uphold the good faith of his client who “forgot” to notify Spip and for whom the purchase of this scooter was important: “He was not aware of being in a state of escape . I plead for release.”

Ultimately the court sentenced him to two months in prison with a committal warrant. He returned to the remand center.
