What will the Ciron declaration of rights be used for?

“We didn’t expect so many people,” admits law professor Alexandre Zabalza. “We don’t joke with Ciron,” reacts one of the participants. The multipurpose hall of Préchac, in South-, is full: this Saturday, January 11, more than 200 people came to attend a public meeting to understand and adopt the declaration of rights of the Ciron valley.

The file put together by students of the DU environmental law at the University of comes from an idea from Jean-Luc Gleyze, president of the Department of Gironde. After the presentation in October in Uzeste, it was time to continue the project. Those present voted by a large majority to validate the declaration of rights and the creation of an association.


More than 200 people came to learn about the notion of common good around Ciron.

1 What does the text say?

The preamble recalls the specificity of the river, its ecosystem, it describes the beech forest more than 40,000 years old, its riparian forest, its micro-climate and its exceptional biodiversity. He also emphasizes the links forged between people and the Ciron valley by calling it a “friendly common living space”. We read there the recognition of its vulnerability, the responsibility of present generations and the duty of protection towards future generations.

This text proclaims that the Ciron valley is an “environmental common good”, that is to say an indivisible whole which connects people around a natural entity. At this stage, the declaration fits on a single-sided A4 sheet, it includes six articles. They state that the valley “has the right to exist, to evolve naturally and to regenerate”, that it has the right to “the preservation, conservation and improvement” of its natural spaces and its biodiversity. .

Article 4, which defines one's right to protection, mentions the possibility of “taking any measure to prevent activities which represent, even in the absence of absolute certainty, a risk of harm or harm to the ecosystem. » Among the participants in the meeting, many are opposed to the high-speed line (LGV) project. The Sepanso association and the Nina and Forêt vivant collectives in particular, insist on the danger it represents for the Ciron valley.

This is the first time that the rights of nature have been recognized in Europe. »

The jurists cited other projects of this type in : the Parliament of the , the Rhône appeal… “The difference is that we do not want to grant legal personality to Ciron, but to the community which would be gathered to defend their rights. We would make it a common good with rights. This declaration will therefore have weight if the association to be created takes advantage of it. »

If the French courts have not yet recognized such texts, the directors of the DU environmental law insist: “Our students are the magistrates of tomorrow, case law could evolve on this subject. »

3 What’s next for the project?

The association, defined in the declaration as “a community organized for the long-term protection [de la vallée du Ciron] » still needs to be created. “We have to move quickly, to hope to represent a counterweight, particularly against the LGV,” notes a resident of Bernos-Beaulac. Three work meetings are scheduled until May with the support of students. The premiere is scheduled for Tuesday, February 18 at 6 p.m. The objective is to submit the statutes before summer.
