The affair had marked public opinion. In February 2023, actor and comedian Pierre Palmade caused a road accident in Seine-et- while he was under the influence of drugs. After 72 hours of partying, he got behind the wheel and hit three members of the same family. Seriously injured, a 27-year-old pregnant woman lost her six-month-old fetus. From Wednesday November 20, the actor will be tried before the criminal court for “unintentional injuries”.

A few days before the opening of the trial, Mourad Battikh, lawyer for the accident victimsguest of RTL, reports that the three people hit during the accident “are doing better physically” and “are recovering slowly, but surely from their injuries and the shock they suffered”. Psychologically, the path is longer: “It’s much more complicated to rebuild on this level after this tragedy”he insists.

More difficult, especially for pregnant women who have lost their six-month-old fetus. According to the lawyer, “she is still affected” by the loss of this child “who was going to be born”. However, Mourad Battikh points out that what is “hardest” for her, is that one’s child is considered “nothing” by the state.

“There is an intentional element”

He explains this feeling by the fact that justice decided to refer Pierre Palmade to the criminal court for involuntary injuries and not for “manslaughter”. A qualification deemed “scandalous” by the lawyer. “Legally, for there to be a homicide, there must be a living being who has died. And there, we had a fetus which was going to be born, alive and viable and which could not because of the accident. There is a direct causal link between the death of this child and the accident. And legally, we draw no consequences from it.”

Mourad Battikh also underlines the responsibility of Pierre Palmade for whom the effect of narcotics is an aggravating circumstance: “There is an intentional element. When we take a cocktail of drugs for several days, we decide to put ourselves in this state and to consume excessively, we decide to take the vehicle and drive. endanger the lives of others.”
