A book evokes the possible bisexuality of Alain Delon. What does the person behind this revelation risk?
It is an event book which is published this Thursday by Bernard Violet. In “The Last Delon Mysteries”, the author publishes the result of 30 years of investigation devoted to the giant of French cinema.
In recent hours, a passage from this book has attracted the attention of all the media. Bernard Violet discusses the actor’s sexuality and numerous testimonies allowing him to think that Delon was bisexual, at least during the first 30 years of his life. A revelation that shocks, not because of its content but because for some it is a form of “outing” with regard to – what’s more – a deceased person.
As a reminder, “Outing someone” means publicly revealing one’s homosexuality or bisexuality. Is this punishable?
What risks?
This is indeed possible provided you file a complaint for invasion of privacy. This can be done in civil proceedings in the event that homosexuality or elements of sexual and therefore private life are revealed, without your consent.
It is then necessary to prove that there was a fault and then damage and that there is a link between the two. If the causal link is proven, the plaintiff will be entitled to damages.
If the revelation is false, in this case, we can turn to criminal law and file a complaint for slander and defamation. This is punishable by a maximum prison sentence of one year and a fine of up to 200 euros.

Angèle and her partner at the time filed a complaint against the media. They won their case. The singer then donated the money to associations.
