We first thought it was an attempted murder, then an accident… Finally, the bullet which passed through the chest of Kendji Girac in the busy travel area of ​​Biscarosse, in the Landes, against a backdrop of alcohol and cocaine, was a fake suicide attempt.

What is the trigger for such a situation? According to the courts, this is a dispute with his partner. While the winner of The Voice came home drunk with 2.5 g of alcohol in his blood, in the middle of the night, waking up their three-year-old child, she said want to leave him.

Alcohol, drugs, argument… All the elements brought together in this context lead us to think of a situation of domestic violence. Does simulating suicide, in particular, fall under this category?

“It’s characteristic”

“I know this from experience: in the majority of cases, men who are alcoholics or drug addicts threaten to commit suicide in front of their partner,” says Maître Nathalie Tomasini, a lawyer specializing in domestic violence, joined by -.

Faking suicide or threatening to do so allows you to tighten the control you have over your partner.

“We must not reverse the roles”

In this case, Kendji Girac is two victims, according to the lawyer. Firstly, his wifewho go feel guilty for having plunged his companion into such a situation. “It will be shown responsible of his distress: she wanted to leave, it made him unhappy and he suffered so much that he took action,” summarizes Me Nathalie Tomasini.

On the other hand, their daughter who was in the trailer when the shot was fired. “She will remain traumatized for many years,” says the lawyer.

“But we must not reverse the roles,” warns Me Tomasini who says she is “personally shocked” by the messages to the advantage of Kendji Girac, making him appear like a victim. “We pity him, we question the rest of his career…”

In reality, reaching such a level of violence does not come out of nowhere.

There is very likely psychological violence existing well in advance. We do not reach extreme violence, as is currently the case, if there has not been violence for months and months.

We don’t know the daily life of this woman,” underlines the lawyer. “And, as in many cases too, she certainly had to minimize everything that happened. »

According to Olivier Janson, prosecutor of Mont-de-Marsan, the young woman had already mentioned acts of violence in the past : the singer had threatened her “to put a bullet in herself and (to) cut her throat” during arguments. Alcohol was also omnipresent in their daily lives: “His drunks were more and more numerous and longer and could last for 48 hours,” reports Olivier Janson.

But no acts of violence physical was not indicated. “In the common mind, domestic violence is associated with physical violence. But we forget the existence and impact of psychological violence » , adds Mr. Tomasini.

The similar case of Alexandra Lange

Jacqueline Sauvage, Valérie Bacot… Me Nathalie Tomasini has defended several women in court accused of having killed their spouse. In 2009, she represented Alexandra Lange. Her partner tries to strangle her after she tells him she wants to leave him. And kills him with a stab. “She had married a man from the traveling community, she was not part of it,” specifies the lawyer. The violence they suffered was daily. Until they bring Alexandra Lange into a situation of extreme violence. She was ultimately acquitted.

Up to five years of imprisonment

Can Kendji Girac be punished for pretending to commit suicide in front of his wife?

Domestic violence are governed by articles 222-1 to 222-67 of the Penal Code. And psychological violence, precisely, in article 222-14-3: “Violence (…) is repressed whatever their nature, including if it involves psychological violence. »

But for this, Kendji Girac’s wife must file a complaint and assert an ITT (total incapacity for work), this penal unit of measurement making it possible to assess trauma following violence. In cases of psychological violence, the ITT is estimated by an objective and neutral forensic psychiatrist.

  • If the ITT is estimated to last less than eight days, Kendji Girac faces up to three years in prison and a fine of 45,000 euros;
  • Beyond eight days of ITT, the singer risks up to five years of imprisonment and a fine of 75,000 euros.

Will Kendji Girac’s wife file a complaint? For the moment, no information has been communicated on this subject. “ It’s not too late for her yet“, slips Me Tomasini. Legally, she has six years to do so.
