The mayor (and president of the Metropolis) of Montpellier, Michael Delafosse announced on his X account (ex-Twitter), this Monday January 6, 2025 at 7:45 p.m., that he had referred thearticle 40 of the code of criminal procedure to report the actions on social networks “of an individual based in Montpellier who makes negationist and anti-Semitic comments”.
The mayor recalls that, “negationism is punishable by the Gayssot law and that incitement to hatred is an offense. Anti-Semitism, racism, hatred of others have no place in Montpellier and in France. Let’s be firm and demanding about our values.”
The targeted Montpellier resident is the influencer Yann Lotte, alias “Anos” on Tik Toka freelance professor who is a former director of the Montpellier campus, who speaks on @Judgedguilty. “He contests the existence of gas chambers while inciting hatred of Jews and Israel! » denounces Michaël Delafosse.
> L’article 40 imposes reporting in a mandatory manner and with the absence of appropriateness control by the public agent on the facts constituting a crime or misdemeanor. The public official must give this report “without delay” to the prosecutor, that is to say “on the spot”.
Already an influencer in police custody
This denunciation to the Montpellier public prosecutor's office comes twenty-four years after the arrest of a Montpellier influencer who called on Tik Tok for the apology of crimes and racial hatred. This 61-year-old retiree, arrested this Sunday at 4:30 p.m. in the city center of Montpellier, saw his police custody extended for 24 hours, this Monday, at the central police station, with a view to his release this Tuesday, January 7 before the public prosecutor .
