Justice has just ruled. The request made by the agglomeration of Châteaubriant-Derval against the Brittany region was rejected by the administrative court of Nantes.
On August 9, 2021, the Brittany region had “informed” the intercommunality “that there would indeed be a daily service during the week of five round trips by train and a journey provided by coach at the end of the afternoon between Retiers and Châteaubriant“. A “ignorance“of their”CONTRACT“, deduced the community of Loire-Atlantique.
-“However, it results from the instruction that following discussions between the parties during the spring of 2021, five round trips by train are set up daily on weekdays“, observed the administrative court of Nantes.
The circumstance that it is not possible to reach Rennes from Châteaubriant by train after 2:53 p.m. does not constitute a breach of contractual obligations.

“The circumstance that it is not possible to reach Rennes from Châteaubriant by train after 2:53 p.m., which is certainly not satisfactory for the community of municipalities, does not constitute a lack of understanding of contractual obligations.“, he believes. “The contract provides for five daily round trips per week, without specifying their distribution during the day.”
Consequence for the court, there are no grounds justifying compensation.
