This is a costly decision. The Nancy Court of Appeal (Meurthe-et-Moselle) sentenced a man to pay an amount of more than 36,000 euros to a property owner. His fault? Having declined a promise to sell a home after having signed it. If the sum is significant, it is above all because the buyer refused to complete the purchase well beyond the regulatory withdrawal period, tell our colleagues from Figaro : the latter normally had a period of 10 days to change his mind. The person concerned was the subject of legal proceedings by the seller of the property as well as by the real estate agency, originally responsible for carrying out the transaction. At first instance, the man who was sued had to pay compensation corresponding to 10% of the transaction value. The property cost 207,000 euros, so the person concerned would have had to pay 20,700 euros.
This was without taking into account the judgment of the Court of Appeal which requested that the buyer also make full payment of the fees owed to the real estate agency. “The buyer's refusal is an error justifying the application of the penalty clause provided for in the mandate,” explains Me Neu-Janicki, specialist lawyer. Added to this are the legal costs of almost 4,000 euros. In total, the score therefore amounts to 36,700 euros for this undecided buyer, or 18% of the total score.
