While the jury had acquitted Joshua Sarroino about two years ago, three judges of the Court of Appeal claim that the trial judge made an error in his instructions to the jury.
On May 10, 2019, the 24 -year -old victim was in the Sofia restaurant for a birthday with friends when a masked shooter entered the trade and fired the man’s head, who died instantly.
The crown argued that the fingerprints and the DNA of Sarroino, a 29 -year -old Lavallois, had been found on a plastic bag in which the firearm was and which had been found near the crime.
But since the man was masked and several witnesses argued that the killer was blond – Sarroino has brown hair – proof of the public prosecutor was therefore circumstantial, according to the defense lawyer, Me Danièle Roy.
-The jury had therefore declared that Sarroino was not guilty.
However, the Court of Appeal decided that it is possible for a suspect to change his hair color “easily”.
The date of the next trial has not been set at the moment.
