After seeing its expulsion from TNT confirmed by the audiovisual regulator, the channel carried out its threats.
The announced counterattack finally arrived. At the end of last week, the NRJ group filed a new summary appeal and an appeal on the merits before the Council of State to contest the fact that NRJ 12 was not selected to be broadcast on TNT from February 2025 .
The channel obviously criticizes the fact that it was not selected to continue the adventure on digital terrestrial television, but also the refusal of Arcom to allocate the frequencies freed up by the withdrawal of Canal+'s pay channels. A modification that was made along the way, thus contradicting the original call for tenders, with only 11 frequencies delivered out of 15.
Arcom, however, justified this decision by explaining that the decision was not likely to call into question the number of services authorized to broadcast free of charge on DTT. The allocation procedure is also criticized: the regulator thus negotiated the agreements of the preselected channels this summer, but for NRJ 12, only these candidates were entitled “to improve their file without giving the same opportunity to others“.
The audiovisual group had already tried to contact the Council of State following the Arcom preselections last summer, but had seen its requests rejected due to the fact that no allocation had been made official.
