The victim was stabbed 61 times, then decapitated and emasculated post-mortem in January 2022. The trial of Smaine M., the accused with 21 convictions to his name, opened this Wednesday, January 15 at the Var assizes.
“I never wanted to kill him. Never, and I regret it.” These words are the first from Smaine M., 41, accused of having fatally stabbed 61 times, then beheaded and emasculated Nabil C. in his apartment in January 2022.
His trial opened for two days at the Var court in Draguignan this Wednesday, January 15, two years almost to the day after the events.
This first day allowed us to quickly hear the accused but above all to take stock of the personality of the Fréjusian. The man also arouses fear within his home and more broadly within his family.
“This circumstance cannot be attenuated”
With 21 convictions to his credit, the latter is described by those close to him as paranoid, a drug addict, addicted to drugs and alcohol and capable of becoming violently angry. Drug consumption, precisely at the center of this file.
“The drama of drugs which will permeate not only the accused but many of the people he invited to his home. This circumstance cannot be attenuated, it is on the contrary aggravating. We consider that he acted even though he knew that he was dangerous when he took drugs,” explains Me Francis Lec, lawyer for the civil parties.
This Thursday, for the second day of the hearing, the witnesses from the evening which preceded the murder should be heard before the interrogation of the accused and the hearing of the experts.
The requisitions in this case could take place this Thursday at the end of the day with a deliberation expected Friday January 17 in the morning. For the murder and acts of torture and barbarity, Smaine M. risks life imprisonment.
