The police officer is being prosecuted for manslaughter while being drunk with a level of 1.28 grams per liter of blood. At first instance, he was sentenced to six months’ imprisonment with a 3-year suspended sentence, a fine of €1,600, a 6-month disqualification from driving and an obligation to retake the four exams.

Do not penalize your family and your employer too much

Through his counsel, Me Corentin Verdure, the defendant asked the appeal court to grant him a probationary stay for the forfeiture of his driving license and not to force him to retake the exams for part C of his license. The request had angered the substitute Yannick Rosart who strongly opposed it, even asking the court to increase the prison sentence from six to twelve months.

The president of the court, Philippe Nazé, did not follow the public prosecutor’s office by confirming the conviction handed down at first instance, but by amending it on two points. “The suspension of his license would of course have an impact on his person, but also, too strongly, on his family and on his employer”explains the judgment. A third of the sentence will be suspended for 5 years. On the other hand, driving reinstatement exams will be limited to category B vehicles.
